This site is intended to provide a gateway for users of on-line or ‘e’ counselling provided via the Atos Healthcare Employee Assistance Programme (EAP). In order to access services described on this site you must first have confirmed eligibility by calling the EAP by telephone.

In these terms and conditions "client" means any registered client member entitled to services through the Atos Healthcare EAP, and "counsellor" means any registered counsellor providing on-line counselling services. These terms and conditions apply for the usage of online counselling, and the use of downloads.

The services are based in the United Kingdom and are governed by English Law. Users of this site and the above named services are advised that the information contained within this website is written by qualified counsellors and doctors.

Atos Healthcare accepts no responsibility for the information contained within the website, nor for any harm incurred from following or not following advice, provided through this site. The information provided within all aspects of the website, online consultations and listed telephone numbers is not designed to replace a face to face consultation with a medical or mental health professional. Online consultations are not intended for diagnosis nor prognosis. Any diagnoses given are tentative only and are designed to be backed up by a full face to face examination by a suitably qualified professional. Clients that take any advice given or gleaned from the website in isolation, do so at their own risk.

Clients commit to behaving appropriately at all times during on-line counselling sessions and in the course of any communication with counsellors and accept that Atos Healthcare will consider any inappropriate behaviour as a serious and fundamental breach of agreement and may terminate their membership at any time, if Atos Healthcare has reason to believe that they have behaved inappropriately i.e. abusive, inappropriate, discourteous, or threatening without the necessity for Atos Healthcare to define or justify the reason for its decision.

Atos Healthcare reserves the right to monitor sessions and all communications without notice to the client for the purpose of ensuring the security of Atos Healthcare and to ensure the safety of counsellors and clients.

Users agree not to make any attempt to contact counsellors other than through the mechanisms supplied by Atos Healthcare and that any attempt to do so will be considered a serious and fundamental breach of these terms and conditions and may lead to immediate termination of their use of the service.

Information on this site remains under the copyright of Atos Healthcare. All rights reserved. No unauthorised duplication of any website or online consultation content, including transcripts from sessions or downloads.

The user agrees that they are over 18.

Credits provided must be used to take sessions within three months of the date that they were allocated. The credits will expire if the sessions are not taken within three months of the date of allocation and except in exceptional circumstances at the sole discretion of Atos Healthcare no extension will be given. It is the responsibility of the client to ensure that they are able to use the credits to take sessions within the lifetime of the credits.

These terms and conditions establish privacy of contract between Atos Healthcare and the client only and the credits may only be used by the client who for whom they were originally allocated. Credits cannot be transferred assigned or negotiated to or with any other third person who is not a party to these terms and conditions.

Session bookings may be cancelled up to 24 hours before the session is due to start and the credit will be re-allocated to the client's account for the purposes of booking further sessions.

Sessions may not be cancelled by the client less than 24 hours before a session is due to start. If the session is not taken by the client the credit will not be re-instated to the client's account.

In the event that the counsellor has to cancel a session booking the counsellor will contact the client via the website to inform them and the credit will be re-allocated to the client's account.

In the event that a counsellor fails to attend a booked session or does not complete the session then the client should contact Atos Healthcare by email using the email facility on the ‘TalktoUsLive.co.uk’ website within 24 hours of the end time of the session. Atos Healthcare will investigate the situation and the credit will be refunded to the client's account if the details of the case are as stated by the client and the cancellation or non-completion of the session was the responsibility of the counsellor.

Atos Healthcare will at all times endeavour to ensure that the technical quality of its service is of the highest quality appropriate to the method of communication but will not be held responsible for technical problems experienced by clients with their own equipment or with communications over the internet or such other causes which are outside of their control.

Any complaint that the client has with the service provided must be communicated by email using the email facility on the ‘TalktoUsLive.co.uk’ website within 24 hours of the end of the session concerned.

Atos Healthcare will not be held liable to the client, his or her counsellor or any other third party for any consequential loss whatsoever that may be claimed as a result of the service it provides or any deemed failure to provide that service.

Atos Healthcare counsellors work to professional confidentiality standards set out by the British Association for Counselling and Psychotherapy. This means that what you discuss will be confidential unless:

  1. you give express and written permission for release of personal and sensitive information
  2. the counsellor considers there is a risk of serious harm, either to yourself or to others
  3. you disclose you have committed a serious crime
  4. you disclose something that, by law, the counsellor has to share with the proper authorities/li>

Atos Healthcare reserves the right to amend the Terms & Conditions at any time and to notify all clients via either email correspondence or other appropriate means.

Although Atos Healthcare uses reasonable efforts to include accurate and up-to-date information in this web site, this web site may include inaccuracies, outdated information or typographical errors. These Terms and Conditions shall be governed by and construed in accordance with English law. Any cause of action against Atos must be commenced in England.
